This document governs your use of PBfitness services.

Please read both sections carefully before purchasing or using any services.

1. Introduction and Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client", "you", or "your") and Petrina Byrne, trading as PBfitness ("we", "us", or "our"), a sole trader operating in England and Wales.

By booking a consultation, purchasing a coaching package, accessing our services, website, app, or any associated digital content, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

These Terms are governed by the laws of England and Wales.

2. About Our Services

PBfitness provides fitness and health coaching services delivered online. Our services may include:

  • Personalised fitness and coaching programmes

  • Personalised nutrition and workout guidance

  • Regular check-ins and progress reviews

  • Access to a coaching app or training platform

  • Messaging and communication support

  • Exercise form reviews and coaching feedback

  • Access to community spaces where applicable

The specific services included in your package will be set out at the point of purchase. Our coaching is delivered entirely online unless separately and explicitly agreed in writing.

3. Eligibility

You must meet the following criteria to purchase or use our services:

  • You must be aged 18 or over, or have written parental or guardian consent if aged 16 to 17

  • You must be capable of entering into a legally binding contract

  • You must not be using our services for any unlawful purpose

By purchasing or accessing our services, you confirm that you meet all of the above criteria.

4. Health and Medical Disclaimer

4.1 Not Medical Advice

PBfitness's services are coaching and wellness support services. They do not constitute medical, clinical, psychiatric, or therapeutic advice, diagnosis, or treatment. Nothing in our programme, communications, or materials should be interpreted as such.

4.2 Your Responsibility

You are responsible for your own health and safety. Before commencing any exercise programme or making significant dietary changes, you should consult a qualified medical professional, particularly if you have any pre-existing health conditions, injuries, or concerns. By engaging our services, you confirm that you have done so or accept full responsibility for not having done so.

4.3 Mental Health

While our coaching may incorporate wellbeing support, we are not therapists, counsellors, or mental health clinicians. If you are experiencing a mental health crisis, please contact your GP, a mental health professional, or a crisis service such as the Samaritans (116 123) or MIND (0300 123 3393).

5. Pricing and Payment

5.1 Pricing

Up-to-date pricing for all services and packages is available on our website. All prices are stated in GBP and are inclusive of applicable taxes unless otherwise stated.

Prices may be subject to change. Any changes will not affect existing confirmed bookings.

5.2 Payment Terms

Full payment is required at the time of purchase unless a separate written payment plan has been agreed. Payment must be made via our authorised payment processor(s). We do not accept cash payments.

5.3 Failed Payments

In the event of a failed payment, access to services may be suspended until payment is received. We reserve the right to charge reasonable administrative fees for persistent payment failures.

6. Minimum Commitment and Cancellation

6.1 Minimum Term

The minimum commitment period for any coaching package will be clearly stated at the point of purchase. If you are on a rolling monthly package, you must give a minimum of 30 days' written notice to cancel. You are liable for payment during any notice period.

6.2 Fixed-Term Packages

Fixed-term packages are non-refundable unless we have failed to provide the services as agreed, or as required by your statutory rights under the Consumer Rights Act 2015.

6.3 Cooling-Off Period

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a 14-day right to cancel from the date of purchase if you have not yet received any services. If you request that services begin within the 14-day period, you acknowledge that your cancellation right may be reduced or extinguished proportionally in accordance with those regulations. To exercise your right to cancel, please contact us in writing at [email protected].

6.4 Our Right to Cancel

We reserve the right to terminate your access to our services immediately and without refund if you breach these Terms, engage in abusive or harassing behaviour toward us or other community members, or engage in any illegal activity in connection with our services. In such cases, we will provide written notice.

7. Your Obligations

To get the most from your coaching and to ensure a safe and respectful experience for everyone, you agree to:

  • Provide honest, accurate, and up-to-date information at all times

  • Engage with the programme in good faith and with reasonable effort

  • Notify us promptly of any health changes, injuries, or circumstances that may affect your ability to follow your programme

  • Treat our team and other community members with respect at all times

  • Not share your coaching materials, login credentials, or programme content with third parties

  • Not reproduce, sell, or distribute any of our materials without prior written consent

8. Intellectual Property

All content, materials, programmes, templates, documents, videos, and creative works produced by PBfitness remain our intellectual property unless otherwise stated in writing. You are granted a personal, non-transferable, non-exclusive licence to use your coaching materials for your personal use only.

You must not reproduce, redistribute, sell, sublicense, or otherwise exploit our intellectual property without prior written consent.

9. Community Standards

Where we operate community spaces, these are safe and respectful environments for all participants. We operate a zero-tolerance policy toward:

  • Discrimination, harassment, or bullying of any kind

  • Hate speech, bigotry, or derogatory language

  • Unsolicited promotional content or spam

  • Sharing of other members' personal information without consent

Violation of community standards may result in immediate removal from our community spaces and/or termination of your coaching contract.

10. Limitation of Liability

To the fullest extent permitted by law, PBfitness and Petrina Byrne shall not be liable for any indirect, incidental, consequential, or special losses arising out of or in connection with your use of our services. Our total liability to you for any claim arising from these Terms or your use of our services shall not exceed the total amount you have paid us in the three months preceding the event giving rise to the claim.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by email at least 14 days before they take effect. Continued use of our services after the effective date of any changes constitutes acceptance of the updated Terms. The current version is always available at www.pbfitness.co.uk.

12. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes shall first be referred to mediation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

As a consumer, you may also have the right to use the UK's Online Dispute Resolution (ODR) platform or seek advice from the Citizens Advice Bureau.

13. Website, Newsletter, Blog, Merchandise and Digital Content

13.1 Website Use

Your use of our website at www.pbfitness.co.uk is subject to these Terms. We make every reasonable effort to ensure the website is accurate, accessible and up to date, but we do not guarantee that it will be free from errors, interruptions or viruses. You access our website at your own risk and are responsible for ensuring your device has adequate protection. We reserve the right to suspend, withdraw or amend our website at any time without notice.

13.2 Accuracy and Information Disclaimer

All information published on our website, blog, social media channels, newsletter and any associated platforms is provided in good faith for general informational and educational purposes only. While we take care to ensure accuracy, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability or suitability of any information provided. You acknowledge that any reliance you place on such information is strictly at your own risk. We strongly encourage you to seek professional advice before acting on anything you read in our content, particularly in relation to health, fitness, nutrition or mental wellbeing.

13.3 Newsletter

By subscribing to our newsletter, you consent to receiving marketing communications from us by email. You may unsubscribe at any time by clicking the unsubscribe link in any email or by contacting us at [email protected]. We will never sell or share your email address with third parties for their own marketing purposes. Newsletter content is provided for informational purposes only and does not constitute professional advice of any kind.

13.4 Blog and Editorial Content

All blog posts, articles, guides and written content published on our website or associated platforms are provided for informational and educational purposes only. They do not constitute medical, nutritional, psychiatric or therapeutic advice and should not be treated as a substitute for professional guidance. Individual results and experiences will vary. Any transformation stories, testimonials or case studies shared are illustrative of personal experiences and are not a guarantee of results. We retain full intellectual property rights over all published content. You must not reproduce, copy, redistribute, republish, upload, post, transmit or otherwise exploit any of our content without our prior written consent. Linking to our content is permitted provided it is done in a way that is fair, legal and does not damage our reputation.

13.7 Merchandise and Physical Products

Where we offer merchandise or physical products for sale, all orders are subject to availability. Delivery timescales are estimates and we are not liable for delays caused by third-party couriers or circumstances outside our control. Returns and refunds for physical products are handled in accordance with your statutory rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013. Faulty or misdescribed items will be replaced or refunded in full. To raise a return or refund request, please contact us at [email protected] within 30 days of receipt. We reserve the right to withdraw or discontinue any product at any time without notice.

13.8 Digital Products and Downloads

Where we offer digital products such as guides, programmes, templates or downloadable content, these are provided for your personal use only and are non-transferable. Due to the nature of digital products, refunds are not offered once a digital product has been accessed or downloaded, except where the product is faulty or misdescribed, in which case your statutory rights under the Consumer Rights Act 2015 apply. All digital content remains the intellectual property of PBfitness and is protected under applicable copyright law.

13.9 Results Disclaimer

Any results, transformations or outcomes referenced across our platforms — whether in testimonials, case studies, social media posts or blog content — reflect individual experiences and are not a guarantee of results. Results will vary depending on a wide range of personal factors including but not limited to commitment, lifestyle, health status and individual physiology. Nothing in our content should be interpreted as a promise or guarantee of specific outcomes.
